Blueberry Kiss Magazine ISSUE 2 - Submission Terms, Conditions &
Author Declaration

1. Scope of Agreement:
These Terms and Conditions govern all submissions of photographs,
illustrations, digital and physical artwork, articles, poetry, and
other related work submitted (collectively referred to as "Work") to
the Blueberry Kiss Magazine ("Blueberry Kiss" as the publisher). By
checking the agreement box or submitting your work through our portal,
you enter into a legally binding contract governed by the laws of the
Republic of South Africa.


2. Licenses Granted (You Keep Your Copyright):
2.1. No Ownership Transfer: In accordance with the South African
Copyright Act 98 of 1978, you retain full ownership and copyright of
your Work.
2.2. Non-Exclusive License: You grant Blueberry Kiss a worldwide,
perpetual, royalty-free, non-exclusive license to:
- Publish, print, reproduce, and distribute the Work in digital,
print, and social media formats of the Magazine.
- Format, resize, crop, or colour-correct the Work to fit the
publication’s layout design.
- Maintain the Work in the Magazine's public digital archives and back-issues.

- Correct any spelling and grammar mistakes.

2.3. Right to Republish: Because this license is non-exclusive, you
remain completely free to sell, license, or publish your Work
elsewhere at any time without our permission. Should you choose to
publish your work with another publication, it is your responsibility
to disclose to the relevant people that your Work has been published
by Blueberry Kiss.
2.4. No Financial Compensation: You explicitly acknowledge that
individual creative submissions are unpaid/non-commission unless
stated otherwise. The consideration for this license is the exposure,
marketing, and professional attribution provided by appearing in the
Magazine.


3. Mandatory Contributor Declaration:
By submitting, you formally declare and warrant that:
- Originality: You are the sole creator of the Work, or you possess
the lawful authority to license it.
- No Plagiarism: The Work does not infringe upon the intellectual
property, copyright, trade marks, or moral rights of any third party.
- Permissions Secured: If your photographs or artwork feature
identifiable human subjects, you have secured the necessary
permission, by said people, before submitting for publishing. If the
Work contains third-party material, you have obtained written
permission for its use.


AI Disclosure: You MUST clearly disclose whether any portion of your
submission(s) is(are) generated or modified using Artificial
Intelligence tools.


4. Commercial Brands & Business Advertorials:
4.1. Exclusion of Free Exposure: The free, exposure-based submission
track applies strictly to individual independent creatives, artists,
and writers acting in their personal capacity.
4.2. Commercial Submissions: Any content submitted by, on behalf of,
or promoting a registered business, commercial brand, agency, or
profit-generating venture is classified as an Advertisement or
Advertorial.
4.3. Mandatory Fees: Commercial entities are strictly prohibited from
utilizing the free creative submission pipeline. Brands and businesses
must contact Blueberry Kiss via the submissions email to secure a commercial
slot and pay the prevailing advertising rates once content has been
reviewed and approved to be published. Blueberry Kiss reserves the
right to reject or pull down any unpaid submission(s) found to be a
disguised commercial advertisement.



5. Consumer Protection Act (CPA) High-Risk Disclaimers:
In compliance with Section 49 of the Consumer Protection Act 68 of
2008, review the following indemnity and liability limitations:
IMPORTANT NOTICE: CONTRIBUTOR INDEMNITY & LIABILITY
By submitting your Work, you legally agree to fully indemnify, defend,
and hold harmless Blueberry Kiss, its directors and employees against
any and all financial losses, damages, legal costs, or claims brought
by third parties resulting from your submission. This means that if
you submit work that is plagiarised, defamatory, breaches privacy
rights, or contains hate speech, and the Blueberry Kiss gets sued, you
will be personally and financially liable for the legal costs and
damages incurred.


LIMITATION OF PUBLISHER LIABILITY:
Blueberry Kiss acts purely as a distribution and display platform for
your creative work. Blueberry Kiss provides no guarantees regarding
the exact publication date, page positioning, or the
commercial/creative reach your work will achieve. To the maximum
extent permitted by South African law, Blueberry Kiss will not be held
liable for any direct, indirect, or consequential loss or damage to
your reputation or digital files arising from your participation.


6. Protection of Personal Information Act (POPIA) Notice:
6.1. Data Collection: Blueberry Kiss collects your personal
information (name, surname, email address, social media handles, and
creative bio) solely to evaluate your submission, credit you
accurately if published, and manage contributor relations.
6.2. Lawful Processing: In line with POPIA (Act 4 of 2013), your data
will not be sold, shared, or distributed to unauthorized third
parties. You consent to your name and social media handles being
printed alongside your published Work for public distribution.


7. General Terms:
7.1. Moral Rights: Blueberry Kiss respects Section 20 of the Copyright
Act. Your right to be identified as the creator of the Work you
submitted will always be upheld via a clear byline or credit.
7.2. Editorial Discretion: Blueberry Kiss retains final editorial
discretion and is under no legal obligation to publish every piece of
work submitted.
7.3. Governing Law: This agreement is governed by the laws of the
Republic of South Africa, and any disputes will fall under the
exclusive jurisdiction of the South African courts.

Please send your files / photos / documents to the dedicated
submissions email. Please don't submit before reading the guidelines,
the dedicated submissions email is listed at the end of the
guidelines.

PLEASE DO NOT USE THE QUERIES EMAIL FOR SUBMISSIONS.

You may submit a maximum of 5 photos per category UNLESS you are
submitting a DIY / makeup tutorial.
Once your submissions have been reviewed, and if approved, we will
contact you with next steps and any related updates by the 18th of
November.
If you don't hear back from us by the 18th of November, please assume
your submission was not accepted for this issue of the magazine. There
will be many more opportunities.


Submission rules/guidelines:

- Avoid submitting photos with excessive or heavy editing/filters

- NO AI GENERATED SUBMISSIONS WILL BE APPROVED

- Photos that are overly revealing will not be published, please keep
it appropriate for under 18s. If you are unsure please contact us at
queries@blueberrykiss.co.za

- Please keep articles between 1-2 pages max

- Please cite your sources, there are websites available to assist
with formatting for direct quotes/paraphrases etc. Plagiarism is not
cool.

- If you are a photographer please get permission from the people in
the photos before submitting them.


- If your photos were professionally taken or taken by a third party
please get permission before submitting them and let us know the name
of the photographer for credit purposes.



- If you submit on behalf of anyone please provide proof that the
original owner agreed to this arrangement. We will not be held liable
for any theft / plagiarism as per the Terms and Conditions.



- If you do not want your social media handles attached to your photos
please let us know and we will not add it.



- If you would like to remain anonymous for your non-photo related
submissions please let us know, or specify which ones when submitting,
and we will credit you as anon. We will not be held liable for any
issues from this decision.


- Please send your files to submissions@blueberrykiss.co.za AFTER you
read this. Save the email.

- PLEASE sort your files and/or label them in order - especially for tutorials.
